Terms and Conditions
Pricing
1. Bathers Paradise's nightly prices are subject to change based on seasonality.
2. The booking system uses dynamic pricing, meaning that daily prices may fluctuate according to supply and demand.
Payment Terms
1. You can book accommodation at Bathers Paradise online, by phone, or in person at our office.
2. By paying for your booking (either in whole or in part), you agree to accept our Terms and Conditions.
3. Once we have processed your payment, we will confirm the details of your booking with you in writing. This confirmation will constitute a binding agreement between you and us (the Agreement).
4. Payment for your booking must be made in Australian dollars.
5. If you pay by American Express (Amex), MasterCard, or Visa (Credit or Debit Card), a card surcharge of 1.3% will be applied to the total transaction value. The surcharge amount will be displayed at the point of booking before proceeding to payment. We reserve the right to adjust this surcharge at any time without prior notice, in accordance with applicable merchant fees and processing costs.
Booking Deposits
1. Off-Peak Periods
When making a booking during off-peak periods, a deposit equal to at least the first night’s rate will be required.
2. Peak Periods
i) For bookings made between the 15th of December and the 31st of January, a 7-night minimum stay applies, and 100% of the total booking amount is required upfront at the time of booking. Shorter stays can be booked starting from the 1st of November.
ii) For bookings from the 1st of February to the 30th of April, a 50% upfront payment is required at the time of booking, with the remaining 50% due on arrival. One-night bookings must be paid in full at the time of booking.
Changing Terms
1. If you wish to change your booking for any reason, you must obtain prior consent from Bathers Paradise.
2. While we will make every effort to accommodate your request, Bathers Paradise may not always be able to change your booking.
3. If we agree to change your booking, the rate for the new dates may be adjusted to reflect the applicable rate for those dates. Legally, this will vary the Agreement between you and us, meaning the total cost of your booking may change.
Transfers
For your safety and security, it is important that we know who is staying at our park at all times. Therefore, your booking:
1. Is provided to you personally (and to any other guests named on the booking in their personal capacity); and
2. Cannot be transferred, resold, or otherwise changed to another person’s name without prior written consent from Bathers Paradise.
Cancellations
We understand that circumstances may arise that require you to cancel your booking. In the event of cancellation, the following policies will apply (please refer to the specific cancellation policy relevant to your booking's time frame):
Off-Peak Periods
If you cancel your booking at any time after it has been made, you will forfeit the amount equivalent to one night’s stay.
Peak Periods
1. 15th of December to the 31st of January
I. Cancellations made more than 30 days before the scheduled arrival date will be refunded, excluding one night’s stay.
II. Cancellations made within 28 days of the scheduled arrival date will result in forfeiture of all monies paid
III. Alterations made within 30 days, such as shortening your stay, will not result in any refunds.
2. 1st February to 31st April
I. If you cancel your booking 14 days or more prior to the arrival date, your deposit will be refunded, minus one night's stay.
II. If you cancel your booking within 14 days of the arrival date, you will forfeit 50% of the total booking amount.
III. If you cancel your booking on the day of arrival, you will forfeit 100% of the total booking amount.
IV. Any alterations made within 14 days of the arrival date, such as shortening your stay, will not result in any refunds, except for bookings paid in full.
Please note: You may request a credit, which must be used within 6 months of issuance. A cancellation fee of one night’s stay will apply.
Early Departures
Once you have checked in, if you make changes to your booking, such as leaving early, you will forfeit the full amount of your booking. This means you will not receive a refund for any unused nights.
No Shows
If you are a "No Show," your booking will be cancelled, and you will not be entitled to a refund. In other words, you will still be required to pay the full amount of your booking.
Refunds
All refunds due to cancellations will be processed on the last business day of the month via a bank transfer or back to the card we have on file when bookings have been made online.
Liability and Indemnity
1. You are always solely responsible for your property at Bathers Paradise.
2. If your property is lost, stolen, or damaged at Bathers Paradise, we are under no obligation to:
I. replace the property.
II. compensate you for; or be liable for any loss or damage suffered as a result.
3. To the maximum extent permitted by law, we are not responsible or liable for any accidents, direct or indirect losses, including but not limited to loss or damage to property, injury, fatality, psychological injury, inconvenience, loss of enjoyment, disappointment, or health-related issues occurring during your stay at Bathers Paradise.
4. You agree to fully and finally release and discharge us from any liability, claim, action, right, or entitlement, whether known or unknown, accrued, contingent, or inchoate, arising out of or relating to your stay at Bathers Paradise.
5. If a condition or warranty cannot be excluded by law, you agree that, to the fullest extent permitted by law, our liability for a breach of that condition or warranty shall be limited, at our sole discretion, to the re-supply of the relevant goods or services or the payment of the cost of re-supply. All other conditions and/or warranties are expressly excluded to the fullest extent permitted by law.
6. You fully indemnify us against any loss, liability, damage, action, demand, expense, claim, fine, charge, or obligation that we may suffer or incur as a result of, or in any way related to, the non-performance or non-compliance of your obligations under this Agreement, or arising from your conduct, actions, or omissions in relation to the booking or your stay at Bathers Paradise.
Vehicles
1. There is a strict one vehicle per site policy.
2. If you have a second vehicle you will need to book a second site, or it will not be allowed within the park grounds.
3. Bathers Paradise is not responsible for any additional vehicles left outside of the park grounds.
Number of Guests
1. There is a maximum number of 6 people per site.
2. Bookings requiring more than 6 people per site need permission from management.
Special Offers and Deals
1. Special offers and deals are subject to change at any time without notice.
2. Only one voucher per site per booking.
Pet Terms and Conditions
1. Guests may bring their pets to Bathers Paradise but do so at their own risk.
2. Pet approval must be obtained at the time of booking, and the decision is at the Property Manager's discretion.
3. Pets must be pre-booked at the time of booking, including information regarding breed and the number of pets.
4. Arrival with additional pets not approved during booking may result in the booking not being honoured and forfeiture of all monies paid.
5. Pets are not permitted inside the amenities block, playground, camp kitchens, barbecue areas, or reception/front office buildings. This does not apply to service animals.
6. Please note that not all guests are comfortable with pets, and we must all be able to enjoy our holiday together.
7. Pets must always be on a lead while on the property, even when contained within your site and the park bounds. There are no off-leash areas within the park.
8. Pets should not be exercised within the park. They must remain within your allocated site at all times.
9. Pets must never be left unattended, including in caravans, tents, or trailers.
10. Guests are solely responsible for cleaning up after their pets on the property and in the surrounding neighbourhood. Pet waste must be cleaned up immediately and disposed of correctly.
11. A pet fee may be charged to your card on file if there are any incidences or breaches of the Pet Policy.
12. Pets must be registered and up to date with their vaccinations.
13. Pets must be healthy, free of parasites such as worms or fleas, etc.
14. Aggressive pets are not permitted.
15. To ensure all guests have an enjoyable stay, pets must remain quiet. Excessive noise, including barking, is not allowed.
16. Pets must be well-mannered and always appropriately restrained by the guest.
17. If your pet causes problems for other guests, the manager reserves the right to terminate your stay, with forfeiture of all monies paid.
18. Ongoing disturbances that affect other guests' experience, such as excessive barking, may result in termination of your stay and additional charges. This may include refunds to other guests due to disturbances caused by your pet.
Important:
19. If a Bathers Paradise manager reasonably deems your pet to be aggressive, dangerous, or destructive, the manager reserves the right to ask you to vacate the property and terminate your stay. In such cases, you will not be entitled to any refund for monies paid for your stay at Bathers Paradise.
20. Guests are fully liable for any loss or damage, including property damage and/or personal injuries, directly or indirectly caused by their pet. Bathers Paradise reserves the right to charge any fees and expenses associated with such loss or damage to the guest's account.
21. To the maximum extent permitted by law, Bathers Paradise will not be held responsible or liable, whether in negligence, contract, or otherwise, for any direct or indirect loss (including, but not limited to, loss of property or person and economic loss), damage, fatality, injury (including psychological trauma), inconvenience, or health-related issue arising from or connected to your pet.
