Bookings and Payment Terms

You can book accommodation at Bathers Paradise either online, on the phone, or in person at our Office.

1. When you make a booking, you will be required to pay a deposit equal to at least the first night’s rate of the booking (Deposit) during non-peak months.  

2. Bookings from the 15th of December to the 31st of January require 100% upfront payment at the time of booking.

3. Bookings from the 1st of February to the 30th of April require 50% of the total booking at the time of booking and then the remaining 50% on arrival.

4. Once you pay for your Booking (either in whole or in part), you will be deemed to have accepted these Terms and Conditions.

5. Once we have processed the payment for your booking, we will confirm the details of your booking with you in writing.  This confirmation creates an agreement between You and Us (Agreement).

6. You must pay for your booking in Australian dollars.

7. If you pay by Amex, MasterCard or Visa Credit or Debit Card we will charge a card surcharge of 1.6% of the total transaction value. The surcharge amount will be displayed at the point of booking before you proceed to payment. We reserve the right to vary the surcharge in accordance with the applicable costs and merchant fees in accepting a credit card payment at any time without prior notice.

Cancelling or Changing Terms

1. If you would like to change your booking for any reason, you must obtain Bathers Paradise prior consent to do so.

2. While we will try our best, Bathers Paradise may not be able accommodate your request to change your booking.

3. If we agree to change your booking, we may adjust the rate that applies to your booking to reflect the applicable rate on the changed booking dates.  In legal terms, this varies the Agreement between You and Us.  In practical terms, this means that the total cost of your booking may change.

4. We understand that from time to time, you may need to cancel your Booking.

5. If you cancel your booking, then the following cancellation policies apply (please check which cancellation policy applies to your specific booking time frame).

5a. For bookings between the 15th of December to the 31st of January

i) if you cancel your booking 30 days prior to arrival date your deposit will be refunded minus one night’s stay

ii) if you cancel your booking within 30 days of your arrival date you will forfeit the full amount set out in your booking.

5b. For bookings between the 1st of February to the 31st of April

i) if you cancel your booking 14 days prior to arrival date your deposit will be refunded minus one night’s stay.

ii) if you cancel your booking within 14 days of arrival you will forfeit the full amount set out in your booking.

5c. For bookings between 1st of May to the 14th of December

i) if you cancel your booking at any time after making the booking you will forfeit one night’s stay.

ii) if you cancel your booking on the day of arrival you are not entitled to a refund.

6. The forfeited amount cannot be transferred to another date or placed in credit for future use without written consent from Bathers Paradise.

7. Once you have checked in, if you make changes to your booking, such as leave early, you will forfeit the full amount set out in your booking. This is, you will not receive a refund for nights unused.

8. If you are a “No Show” your booking will be cancelled, and you will not be entitled to a refund. That is, you will still be required to pay the full amount set out in your booking.

9. For your safety, it’s important we know who is staying at our Park at any given time.  For this reason, your booking:

a. is provided to you in your personal capacity (and any other guests named on the booking in theirs); and

b. cannot be transferred, resold, or otherwise changed into the name of another person without Bathers Paradise prior written consent.

Liability

1. You are always solely responsible for your property at Bathers Paradise.

2. If your property is lost, stolen, or damaged at Bathers Paradise, we are under no obligation to:

a. replace the property.

b. compensate you for; or

c. be liable for any loss or damage suffered as a result.

3. To the maximum extent permitted by law, we are not responsible or liable for any accident or, direct or indirect loss including but not limited to loss suffered to property or person, damage, fatality, injury, psychological injury, inconvenience, loss of enjoyment, disappointment or health related issue whatsoever during your stay at Bathers Paradise.

4. You agree to fully and finally release and discharge us from any liability, claim, action, right or entitlement whatsoever you have against us whether known or unknown, whether accrued, contingent or inchoate arising out of, concerning or relating to your stay.

5. If you wish to claim any refund you must contact Bathers Paradise directly by calling (08) 9071 1014.

6. If a condition or warranty cannot be excluded at law then you agree to the fullest extent permitted by law that our liability for a breach of the condition or warranty shall be, at our sole election, the re-supply or payment of the cost of re-supply of the relevant goods or services. All other conditions and/or warranties are expressly excluded to the fullest extent permitted by law.

7. You fully indemnify us against any loss, liability, damage, action, demand, expense, claim, fine, charge or obligation which we have or may suffer or incur by reason of or in any way consequent upon, arising out of or incidental to the non-performance or non-observance of the obligations and liabilities imposed on you under this Agreement or by reason of or concerning or arising out of your conduct, act or omission on or related to the Booking or your stay at Bathers Paradise.

Pet Terms and Conditions

1. Guests may bring their pets to Bathers Paradise, permitted at their own risk.

 2. Pet approval must be obtained when booking and decision is at the Property Managers discretion.

 3. Pets must be pre-booked at the outset of booking (including information regarding breed and number of pets).

 4. Arrival with additional pets on check-in may result in the booking not being honoured and forfeiture of all monies paid.

 5. Pets are not permitted inside, amenities block, playground, camp kitchens, barbecue areas, and reception/front office buildings. This does not apply to service animals.

 6. Please also note that not all guests enjoy pets, and we must all holiday happily together.

 7. Pets must be on a lead at all times whilst on the property, even when contained within your site and the park bounds. There are no off-leash areas within the park.

 8. Please must not be exercised inside the park, whilst in the park they are to be kept within your allocated site.

 9. Pets are not to be left unattended at any time, including in caravans, tents, or trailers.

 10. Please make sure you clean up after your pet. Guests are solely responsible for cleaning up after their pets on the property and in the surrounding neighbourhood. Mess must be cleaned up straight away and disposed of correctly.

 11. A pet fee may be charged to your card on file if any incidences or breaches to the Pet Policy occur.

 12. Pets must be registered and up to date with their vaccinations.

 13. Pets must be healthy. ie: free of worms, fleas etc.

 14. Aggressive pets are simply not welcome.

 15. So that all our guests can enjoy their stay, please always keep your pet quiet. Excessive noise, including barking, is not allowed.

 16.  Pets must be well mannered and always appropriately restrained by the Guest.

 17. If your pet is causing problems with other guests, the manager has the right to terminate your further stay and forfeiture of all monies paid.

 18.  Any ongoing disturbances that affect guests’ experience, such as barking, may result in termination of your further stay and further charges incurred. This may include refunds given to other guests due to disturbances.

 Important:

If a Bathers Paradise manager reasonably considers that your pet acts in any way considered to be aggressive, dangerous, or destructive, the manager reserves the right to ask you to vacate the property and terminate your stay, in which case you will not be entitled to any refund of monies paid for your stay at Bathers Paradise.

Guests are liable for all loss and damage. Including property damage and/or personal injuries, which occurs directly or indirectly resulting from their pet. Bathers Paradise reserves the right to apply all fees and expenses associated with any such loss and damage to the Guest’s account.

To the maximum extent permitted by law, Bathers Paradise will not be held responsible or liable whether in negligence, contract or otherwise if any person incurs, experiences, or suffers any direct or indirect loss (including but not limited to any loss suffered to property or person and economic loss), damage, fatality, injury (including psychological trauma), inconvenience or health-related issue whatsoever arising out of or connected to your pet.
